EU Points to Article 39 for Possible Exemption for Tesla FSD

An inquiry to the EU Commission as to whether Tesla’s Full Self Driving (FSD) software could be approved in the EU received a response referring to the type approval process itself and a possible exemption. This refers to Article 39, which creates exemptions for innovative technologies.

However, the Commission also adds that Tesla has not yet submitted an application for such an exemption or type approval. It is not yet known whether Tesla will apply for an exemption in Europe or go through the type approval process. Here is the correspondence:
